The Emergency Medical Treatment and Labor Act (EMTALA), also known as the “patient dumping statute,” is a federal law that requires Medicare-participating hospitals with emergency departments to provide a medical screening examination to anyone who presents to the emergency department and requests treatment, regardless of their ability to pay or insurance status. If an emergency medical condition is found, the hospital must provide stabilizing treatment or an appropriate transfer.
